Being a retirement plan fiduciary is a difficult and complex responsibility – a role that carries with it personal liability that pierces the “corporate veil.” Unfortunately, most plan fiduciaries lack the training, knowledge and resources required to fulfill their legal duties, thereby exposing their organizations and themselves to significant risk. With heightened compliance enforcement by the IRS and Department of Labor and arbitration and litigation for fiduciary breaches running at an all-time high it is likely that complaints and lawsuits alleging plan mismanagement will continue to increase. This session will equip plan fiduciaries with a deeper understanding of ERISA’s fiduciary requirements, a broad perspective of the current legal and regulatory environment as well as practical steps they can take to effectively manage their responsibilities and minimize their risk.
